The
RULES
OWNER RESPONSIBILITIES
INTRODUCTION
It is important that we
preserve the living and architectural style that Church Hill School Condominium
represents. The goal of these Rules and
Regulations is to provide reasonable, practical guidelines for the operation of
Church Hill School Condominium. All
residents and guests are obligated to comply with these Rules and Regulations
and the Association’s Governing Documents.
References to the Association mean the Board acting for and on behalf of
the Association.
1. Each Owner is to advise his/her tenant or guest of
these Rules and Regulations, and leave a copy accessible to the tenant or
guest. Owners shall in all cases be responsible for any infraction or violation
of these rules.
2. No improper conduct, obscenities, verbal or physical
threats by Members, residents, tenants, family and/or guests will be tolerated.
Actions by any person of any nature, particularly in the Common Areas, which
may be dangerous, create a health or safety problem, create a hostile
environment, or disturb others, are not permitted. This includes noise,
intoxication, quarreling, threatening, fighting, offensive or abusive language
or behavior.
3. Members are responsible for the conduct of their
guests, family, and/or tenants and all service personnel, vendors, contractors,
and any other invitees.
4. All Members, their tenants, family and/or guests are
presumed to conduct themselves appropriately, with due consideration for each
other. The Board of Directors has the power to discipline any person for any
conduct, which in its opinion, tends to endanger the welfare, interest or
character of the Association and/or its employees, as well as for violations of
the specific rules and regulations of the Association.
5. Any damage to the building, landscaping, equipment or
any other common area property caused by an owner, his/her tenant(s), guest(s)
or employee/contractor(s) shall be considered the responsibility of the Owner
and all costs of resulting repairs and/or replacements(s) shall be borne by
such Owner.
6. Any Owner, his/her guest or tenant who violates any of
these Rules and Regulations of the Association shall be subject to its Rules
Enforcement Procedures.
7. Management will inspect storage rooms annually.
Unidentified items will be removed. Notice of upcoming inspection will be given
in quarterly bulletins.
8. Use of Common Area is limited to the Owners, their
families, Lessees and Guests.
9. No odor shall be permitted to arise from any unit so
as to render the Property of any portion thereof unsanitary, unsightly,
offensive or detrimental to the welfare and health of any other Owner or
resident or any other property in the vicinity.
10. For health reasons, garbage and refuse should be placed
in leak proof trash bags and deposited in designated trash receptacles.
11. Seasonal decorations, in keeping with architectural
character and scale of the units and community, may be displayed. Outdoor
winter holiday lighting may be displayed between Thanksgiving and January 8.
Decorations for other holidays may be displayed three (3) weeks prior to the
holiday and removed one (1) week after the holiday.
12. Cable System Access. In the event the Board of Directors authorizes any sort of
master cable or community television or data system, each owner hereby
authorizes access to his unit upon reasonable notice for the purpose of
installing the conduits and fixtures necessary to serve such unit, without
regard to whether the owner then elects to subscribe to or use such system.
13. Rules and Regulations. The Board of Directors
may from time to time adopt, promulgate and publish other rules of conduct
reasonably relating to the enjoyment of the cooperative by owners and
occupants, including rules for the use of recreational facilities and
amenities, provided that no such rules and regulations may have the effect of
contradicting a provision of this Declaration or the bylaws.
14. No Time Shares.
Time Shares are not permitted.
15. Smoking. No
smoking is allowed on common spaces, inside or outside.
INDIVIDUAL UNITS
1. Exterior
alterations or additions of any type are not permitted without the written
consent of the Board of Directors.
2. Display of
non-commercial signs and/or flags are not authorized.
3. A real estate
sign may be displayed from within the confines of the unit and not on common
area.
4. No Unsightly
Uses. No clothes, sheets,
blankets, laundry of any kind, or other articles shall be hung out on any
portion of a unit so as to be visible from outside the unit, nor shall a
clothesline (including retractable clotheslines) be installed or maintained on
the common elements, on a balcony, or on the exterior of any unit without
approval of the Board of Directors.
COMMON AREAS
1. Outside antennae
and satellite dishes may not be placed on the building exterior walls.
2. Landscaping. No one shall harm, mutilate, destroy, alter or
litter any of the landscaping work or improvements on the common elements,
including grass, trees, and flower beds.
PARKING
1. Vehicle
Storage. No boats, snowmobiles,
trailers, camping vehicles, buses, camper tops, "all-terrain
vehicles", tractor/trailers or trucks in excesses of 9,000 pounds gross
vehicle weight, or unlicensed or inoperable vehicles shall at any time be
stored or parked on the common elements without the express written approval of
the Board of Directors, which may be withheld without stated reason.
2. Vehicles must be
maintained so as not to damage the parking areas and paved surfaces (i.e.
leaking oil or other fluids). The Association shall cause homeowner to whom the
vehicle is associated to pay for any necessary repairs to the Association
property; such expenses shall become an assessment to the account of said Homeowner.
3. Owner’s vehicles
are to be parked within their assigned parking area.
PETS
1. Pets. A maximum number of 1 dog, weighing
less than 20 pounds, and/or 2 cats will be allowed. Other small quiet pets may
be allowed with Association approval. All pets must remain in owner’s unit
unless accompanied by member. In no case will pet(s) be allowed to roam freely
in or on any of the common spaces, inside or outside. PETS
2. All pets are the
responsibility of the Owner and therefore the Owner is responsible for cleaning
up any waste products. This must be done immediately. Litter must be put in a
tightly closed plastic bag before being disposed.
3. Pets must not be
left outside when Owners are away. Pets must be secured within the unit.
4. Pets must be kept
free of fleas and parasites to avoid the infestation of units and common area.
5. Owners are
responsible for any “visitor” pets, which are subject to these same pet rules.
6. Leaving pet food
in common areas is forbidden.
STORAGE
ROOMS
Small
items may be stored in the storage rooms subject to the following rules:
1. The storage rooms are shared by multiple users.
The Association, Board of Directors and its managers have NO RESPONSIBILITY for
the items stored in the storage rooms. Property is stored in the storage rooms
at the owners’ risk.
2. Stored items must
be placed in boxes or in cabinets or on shelves that have the owners’ names and
unit numbers marked on them.
3. No large items
such as furniture including beds, appliances, doors, screens, automotive items
such as tires, gas cans, batteries, may be stored.
4. No flammable
items may be stored; any flammable items observed by management will be
promptly removed.
5. Bicycles must be
marked with the owners’ names and unit numbers and put in the bike racks.
6. Items in the
storage rooms that have no name or unit number on them are subject to be removed
and discarded by the Association.
CONDUCT
1. Any improper
conduct or obscenities will not be tolerated. Actions by any person of any
nature, which may be dangerous or construed to be a threat, create a health or
safety problem, or disturb others, are not permitted.
2. An Owner is
responsible for the conduct of his/her guest, family, and/or tenants, and all
service personnel, vendors, contractors, and any other invitees.
3. Disturbing
noises, which may interfere with the quiet enjoyment of others, is not permitted.
4. The Board of
Directors has the power to discipline any person for any conduct which in its
opinion may endanger the welfare, interest or character of the Association, as
well as for violations of specific rules.
5. Association
vendors and their employees are to be treated in a courteous and considerate
manner. All complaints regarding service rendered or behavior by any vendor
and/or its employees must be made to the management company for appropriate
handling.
1. All Buildings and
Common Areas are designated for residential use shall be used, improved and
devoted exclusively to and for residential use.
2. Leases. Any lease between an owner and a lessee shall
provide that the terms of the lease shall be subject in all respects to the
provisions of this Declaration, the Articles of Incorporation and the Bylaws,
and that any failure by the lessee to comply with the terms of such documents
shall be a default under the lease enforceable by the Association as well as the
landlord. A lease of a unit must be for an entire unit, not a portion
thereof. All leases of units must be in writing and a copy shall be filed with
the Association prior to commencement of the term. No lease of a unit may
be for a period of less than neither three months, nor more than 12 months or
provide for hotel type services. All leases shall be deemed to include,
for the term of the lease, all of the owner's rights to use the recreational
facilities, common rooms and open spaces of the cooperative, and no owner shall
be permitted the use thereof unless they currently occupy the unit. Other
than the foregoing, there shall be no restrictions on the right of any owner to
lease a unit.
CONSTRUCTION
For any form of construction
on Church Hill School Condominium property, the following requirements must be
met:
Prior to start of construction:
1. The Owner shall provide Board of Directors with a general
plan or description of proposed construction.
2. If any structural components of the building are affected, the
Owner shall provide documentation from a licensed engineering firm showing that
the structural integrity of the building will not be compromised.
3. The owner assumes all responsibility to insure that anyone
he/she hires to do work at
4. The Owner shall provide each contractor with a copy of Rules
& Regulations section titled “Construction”
and provide CHSCA with signed receipt of same and a certificate of insurance from
each contractor.
During Construction:
1. FIRE WALLS: Fire walls must be maintained between each unit
and the common spaces (hallways, storage rooms, stairwells) as well as between
each unit and the neighboring unit. Firewalls are to consist of one layer of
5/8” sheetrock on each side of the wall that is COMPLETELY UNINTERUPTED and
fire-taped. Plumbing pipes and electrical wires may penetrate the fire walls,
but must be fire-caulked to maintain proper fire rating. Any ducts penetrating
the fire walls must have fire-rated dampers installed at the point of
penetration.
2. FIRE-RATED FLOORS: All floors or ceilings between each unit
and a neighboring unit or common spaces (hallways, storage rooms, stairwells,
parking garage) must be maintained at their fire rating. Plumbing pipes and
electrical wires may penetrate the fire-rated floors/ceilings, but must be
fire-caulked to maintain proper fire rating. Any ducts penetrating the
fire-rated floors/ceilings must have fire-rated dampers installed at the point
of penetration.
3. CLEANLINESS: The common spaces of the building are to remain
clean at all times. Any dust or debris accumulating in the common spaces will
be cleaned up prior to the end of each work day. If extraordinary cleaning is
required in the common spaces due to construction, the Owner will be charged
for the cleaning and it will be the responsibility of the Owner to recover the
cost of cleaning from the contractor(s).
4. DOORS: All doors are to remain closed at all times to
prevent dust from entering the common spaces. Doors must be propped open while
carrying tools and materials into the construction area, but immediately be
closed again when not required to be open for passage.
5. ELEVATOR: If the elevator is used to lift tools or materials,
the protective blankets must be installed to protect the elevator interior. (2500
lb limit)
6. STORAGE: The common space hallways and entryways’ use as a
storage or staging area must be minimized and should not exceed 24 hours.
7. NOISE: Construction noise that may bother the residents of the
building will be allowed only during the hours of
8. MATERIAL DELIVERY: It is highly recommended that all building
materials be delivered by a lift and through the windows of the unit under
construction in order to prevent damage to the common spaces. If this is not
possible, then the owner of the unit under construction will be held liable for
any damages to the common spaces. It will be the responsibility of the owner to
determine the contractor responsible for the damages and to recover the costs
of repairs to the common spaces from that contractor.
9. DEBRIS: It is the responsibility of the Owner to provide for
the removal of construction debris. Construction debris may NOT be set in or
near the regular common space dumpster container(s).
Immediately after construction is completed:
1. For new construction, and if applicable for remodeling, the Owner
shall provide CHSCA with evidence of final electrical inspection by Minnesota
State Electrical Inspector.
2. For new construction, and if applicable for remodeling, the Owner
shall provide CHSCA with evidence of final plumbing inspection by Minnesota
State Plumbing Inspector.

VIOLATIONS/HEARINGS
When there is a violation of these Rules and Regulations or the Governing Documents, the Board is authorized to pursue various remedies. These remedies include legal action for damages or equitable relief in any court, imposition of late charges for past due assessments, imposition of reasonable fines for violations, and the correction of any exterior condition in a Unit which violates the Rules and Regulations or Governing Documents Prior to the Board imposing a fine for any violation, the Board shall, upon written request of the offending Owner, grant the Owner a fair hearing.
